    Irresponsible alcohol consumption is a complicated regulatory issue globally. Governments’ regulatory regimes for the alcoholic drinks sector are primarily concerned with issues such as control of the production, sale, and use of alcoholic drinks for purposes of safeguarding the health of the individual in view of the dangers of excessive consumption of alcoholic drinks. This article is intended to offer insights on post-legislative scrutiny by drawing on lessons from alcoholic drinks regulation in Kenya. Post-legislative scrutiny as a methodology largely reviews government action or inaction and consequently proposes measures to be undertaken for purposes of managing the effective implementation of its policies and abiding by legal obligations in relation to regulatory frameworks and actions. The intention is to highlight the failures and insufficiencies of the different approaches on alcohol regulation and the manner in which they have been utilized to regulate and control abuse of alcoholic drinks. By comparing regulatory outcomes with the intended policy outcomes and design of regulatory regimes the authors make the case for the primacy of post-regulatory scrutiny and to provide suggestions on how it can be improved in settings such as Kenya’s.

    The perception of how the interests of vulnerable adults should be protected has been changing over time. Under the influence of human and patient’s rights a profound shift of protection paradigms has taken place in the last decades. In the framework of this shift, in addition to traditional adult guardianship measures, new instruments have been developed allowing adults to play a greater role in the protection of their (future) interests. This has also been the case in the Netherlands, where adults in the course of the last decade have acquired the possibility to make a so-called living will, internationally better known as a continuing, enduring or lasting power of attorney. This article discusses this instrument, in comparison with the traditional adult guardianship measures currently in force in the Netherlands, from the perspective of the new protection paradigm based on a human rights approach.

    In de afgelopen decennia is de manier waarop naar de bescherming van kwetsbare meerderjarigen wordt gekeken, veranderd. Van een benadering waarbij de focus voornamelijk lag op bescherming is de nadruk steeds meer komen te liggen op het recht op autonomie en zelfbeschikking van de meerderjarige. De opkomst van mensen- en patiëntenrechten heeft geleid tot het ontstaan van een nieuw beschermingsparadigma. In dat kader zijn nieuwe instrumenten ontwikkeld, die meerderjarigen een grotere rol toekennen in de bescherming van hun (toekomstige) belangen. Dit is eveneens het geval in Nederland, waar meerderjarigen een levenstestament kunnen opstellen om voorzieningen te treffen voor een toekomstige periode van wilsonbekwaamheid. Dit artikel bespreekt het levenstestament, in samenhang met de traditionele rechterlijke beschermingsmaatregelen, vanuit het perspectief van het nieuwe beschermingsparadigma.

    Germany reacted to the rise of piracy around the Horn of Africa not only by deploying its armed forces to the region, but also by overhauling the legal regime concerning private security providers. It introduced a dedicated licensing scheme mandatory for German maritime security providers and maritime security providers wishing to offer their services on German-flagged vessels. This legal reform resulted in a licensing system with detailed standards for the internal organisation of a security company and the execution of maritime security services. Content wise, the German law borrows broadly from internationally accepted standards. Despite deficits in state oversight and compliance control, the licensing scheme sets a high standard e.g. by mandating that a security team must consist of a minimum of four security guards. The lacking success of the scheme suggested by the low number of companies still holding a license may be due to the fact that ship-owners have traditionally been reluctant to travel high-risk areas under the German flag. Nevertheless, the German law is an example of a national regulation that has had some impact on the industry at large.

    The human services are fraught with history of failure related to grasping oversimplified, across-the-board solutions that are expected to work in all situations for all groups of people. This article reviews some of the long-standing and current challenges for governance of programmes in maintaining cultures that safeguard restorative and responsive standards, principles and values, thereby amplifying and enhancing their centrality to relational engagement within families, groups, communities and organisations. Despite their potential for helping groups of people grapple with the complex dynamics that impact their lives, restorative justice approaches are seen as no less vulnerable to being whittled down to technical routines through practitioner and sponsor colonisation than other practices. This article explores some of the ways culture can work to erode and support the achievement of restorative standards, and why restorative justice and regulation that is responsive to the ongoing experiences of affected persons offers unique paths forward for achieving justice. Included in this exploration are the ways that moral panic and top-down, command-and-control management narrow relational approaches to tackling complex problems and protect interests that reproduce social and economic inequality.

    The purpose of this article is to examine restorative approaches to campus sexual harm. A restorative response may provide support and validation for survivors, a pathway for personal change for those who cause sexual harm, and assist in changing campus culture. The article addresses three significant challenges to developing a restorative response. The first challenge is the influence of a pervasive ideology that I refer to as crime logic. A second challenge is the need for an intersectional response that addresses the potential for bias in decisions by campus administrators and restorative justice practitioners. The third challenge is to develop restorative approaches for circumstances in which a victim/perpetrator dyad is not appropriate.

    The maxim ‘law in books and law in action’ relays an implicit dichotomy, and though the constitutive nature of law is nowadays commonly professed, the reflex remains to use law in books as an autonomous starting point. Law however, it is argued in this article, has a storyline that commences before its institutional formalisation. Law as ‘a continuous process of becoming’ encompasses both law in books and law in action, and law in action encompasses timelines both before and after the formal coming about of law. To fully understand law, it is necessary to understand the entire storyline of law. Qualitative studies in law and society are well equipped to offer valuable insights on the facets of law outside the books. The insights are not additional to doctrinal understanding, but part and parcel of it. To illustrate this, an ethnographic case study of local bylaws regulating an ethnically diverse public space of everyday life is expanded upon. The case study is used to demonstrate the insights qualitative data yields with regard to the dynamics in which law comes about, and how these dynamics continue for law in action after law has made the books. This particular case study moreover exemplifies how law is one of many truths in the context in which it operates, and how formalised law is reflective of the power constellations that have brought it forth.

    Studies have shown that the effects of scientific research on law and policy making are often fairly limited. Different reasons can be given for this: scientists are better at falsifying hypothesis than at predicting the future, the outcomes of academic research and empirical evidence can be inconclusive or even contradictory, the timing of the legislative cycle and the production of research show mismatches, there can be clashes between the political rationality and the economic or scientific rationality in the law making process et cetera. There is one ‘wicked’ methodological problem, though, that affects all regulatory policy making, namely: the ‘jump’ from empirical facts (e.g. there are too few organ donors in the Netherlands and the voluntary registration system is not working) to normative recommendations of what the law should regulate (e.g. we need to change the default rule so that everybody in principle becomes an organ donor unless one opts out). We are interested in how this translation process takes place and whether it could make a difference if the empirical research on which legislative drafts are build is more quantitative type of research or more qualitative. That is why we have selected two cases in which either type of research played a role during the drafting phase. We use the lens of the proportionality principle in order to see how empirical data and scientific evidence are used by legislative drafters to justify normative choices in the design of new laws.

    This study uses a Jerusalem-based restorative justice programme as a case study to characterise community restorative justice (CRJ) conferences. On the basis of the Criminal Law Taxonomy, an analytical instrument that includes seventeen measurable characteristics, it examines the procedural elements of the conferences, their content, goals and the role of participants. The analysis uncovers an unprecedented multiplicity of conference characteristics, including the level of flexibility, the existence of victim-offender dialogue, the involvement of the community and a focus on rehabilitative, future-oriented outcomes. The findings offer new insights regarding the theory and practice of CRJ and the gaps between the two.

    This article introduces a mentoring programme for justice-involved youth that utilises the unique and often overlooked resources offered by adults with a history of incarceration, and the innovative training model that aims to promote secondary desistance and restorative justice among the mentors. An examination of the generative role of peer mentoring and its overlap with restorative justice as a healing process that provides opportunities for offenders to make indirect amends that contribute to the social rehabilitation of their communities is presented. An overview of the history and anticipated aims of mentoring programmes for justice-involved youth is provided, followed by a discussion of the importance of secondary desistance in peer mentoring programmes and a review of the elements, conceptual underpinnings and anticipated benefits of the training programme for the mentors. The training programme is argued to offer approaches that support the primary and secondary desistance-orientated changes and the reparative work needed within the mentor.

    The community paradigm is continually cited as an important influence within restorative practices. However, this influence has not been sufficiently clarified. This article seeks to answer this conundrum by identifying a novel meso-community of care, concern and accountability that has been emerging as part of adult reparation panel procedures. This offender-centric community consists of traditionally secondary justice stakeholders led by criminal justice representative professionals including police officers and probation officials. It also includes lay volunteers and reparation programme officials dependent on state funding and cooperation. Professionalised panellists have led the development of surrogate familial bonds with offenders through the incorporation of a welfare ethos as part of case discourses. This care and concern approach has increased opportunities within case agreements for successful reintegration and rehabilitation. However, this article also acknowledges some concerns within panel processes in that, by attempting to increase accountability for harms caused, there is a danger that panellists are blurring the restorative lines between rehabilitation and genuine restoration and reparation.

    The purpose of this article is to explore the literature on restorative justice (RJ) as employed in educational settings and its relationship to student achievement and to present it as a model for working with high-needs populations. While there is no single measure to determine ‘need’ amongst students, the reference in this article is to particularly vulnerable populations of students, due to racial, linguistic, academic or other differences. Information sources utilised in this study were chosen based on their relevance to the application and assessment of RJ programmes implemented with youth in school systems, with a particular focus on its relevance in the context of the United States. This article points at the history of RJ and how particularly impactful such programmes can be with this target group, given the aims and desired outcomes of this philosophy.

    As evidence-based legislation develops, and as technology puts more information at our fingertips, there should be a better understanding of what exactly constitutes reliable evidence. Robert and Ann Seidman devoted their professional careers to developing the evidence-based Institutional Legislative Theory and Methodology and teaching it to legislative drafters around the world. Although ILTAM was firmly grounded in – and driven by – evidence, the question becomes what evidence is reliable and a worthy input for the methodology. Further, how can the drafter avoid the misuses of evidence such as confirmation bias and naïve beliefs? We aim to give a guide for using evidence by offering examples of evidence-based legislation in practice and through a proposed hierarchy of evidence from most to least reliable:

    1. Experiments within the jurisdiction / lessons from other jurisdictions.

    2. Information on a topic or issue that was formally requested by the legislature or produced to the legislature under oath or under the penalties of perjury.

    3. Studies / information provided by a government agency.

    4. Expert or scientific studies.

    5. Economic or mathematical models and statistics.

    6. Information provided by special interests.

    7. Stories, apocrypha and uncorroborated tales.


    We hope that this hierarchy provides a starting point for discussion to refine and improve evidence-based legislation.

Access_open The Integrity of the Tax System after BEPS: A Shared Responsibility

    The international tax system is the result of the interaction of different actors who share the responsibility for its integrity. States and multinational corporations both enjoy to a certain extent freedom of choice with regard to their tax behaviour – which entails moral responsibility. Making, interpreting and using tax rules therefore is inevitably a matter of exercising responsibility. Both should abstain from viewing tax laws as a bunch of technical rules to be used as a tool without any intrinsic moral or legal value. States bear primary responsibility for the integrity of the international tax system. They should become more reticent in their use of tax as regulatory instrument – competing with one another for multinationals’ investment. They should also act more responsibly by cooperating to make better rules to prevent aggressive tax planning, which entails a shift in tax payments from very expert taxpayers to other taxpayers. Here, the distributive justice of the tax system and a level playing field should be guaranteed. Multinationals should abstain from putting pressure on states and lobbying for favourable tax rules that disproportionally affect other taxpayers – SMEs and individual taxpayers alike. Multinationals and their tax advisers should avoid irresponsible conduct by not aiming to pay a minimalist amount of (corporate income) taxes – merely staying within the boundaries of the letter of the law. Especially CSR-corporations should assume the responsibility for the integrity of the tax system.

    De studie beoogt aan de hand van 87 dossiers van gezag- en omgangsonderzoeken door de Raad voor de Kinderbescherming (RvdK) meer inzicht te krijgen in situaties waarin de ene ouder de andere ouder in het kader van een (echt)scheiding beschuldigt van seksueel misbruik van kinderen. De dossiers zijn gekoppeld aan bijbehorende civielrechtelijke beschikkingen en het Justitiële Documentatiesysteem. Hierdoor is de problematiek van verschillende kanten belicht. Uit het onderzoek blijkt dat het over het algemeen complexe zaken zijn, waarin naast de BSKM nog meer problemen zijn binnen de gezinnen. De aard van het vermeende seksueel misbruik is ernstig, en de kinderen gemiddeld jong. Regelmatig is de beschuldiging geuit bij politie en hulpverlening vóór de rechtszaak en het raadsonderzoek. De rechtszaken betreffen over het algemeen procedures omtrent gezag, verdeling van zorg- en opvoedingstaken en omgang. Vrijwel nooit is vast te stellen of het seksueel kindermisbruik heeft plaatsgevonden. Slechts drie ouders zijn veroordeeld voor het misbruik. Eén vader is vrijgesproken, twee vaders zijn niet nader vervolgd omdat zij ten onrechte als verdachte waren aangemerkt. Civiele rechters die beslissingen moeten nemen over de kinderen staan voor een dubbel dilemma: het al dan niet serieus nemen van de beschuldiging kan schadelijke gevolgen hebben voor kinderen, en daarnaast kan, vanwege de onzekerheid over de gegrondheid, een beslissing tot nader onderzoek ook schadelijk zijn omdat dit het proces verlengt. De RvdK adviseert de rechtbank regelmatig om definitieve beslissingen omtrent de kinderen aan te houden, in afwachting van bijvoorbeeld hulpverlening of een ondertoezichtstelling. Het is echter doorgaans niet de waarschijnlijkheid van het SKM, maar de gevolgen van de beschuldiging zelf waar de RvdK zijn zorgen regelmatig over uit. Hierdoor lijkt het dat de beschuldiging, en niet het potentiële misbruik, een katalysator is voor onwenselijke gevolgen voor de kinderen.

    This study aims to provide insight into allegations of child sexual abuse in the context of divorce and related proceedings by reviewing 87 files concerning investigations by the Dutch child protective service (CPS). These files are linked to the court rulings about the families in question, as well as the criminal record database. This makes it possible to look at this problem from various angles. The study shows that the cases are generally complex, in which aside from the allegations of sexual abuse, other issues existed within the families. The nature of the alleged abuses were serious, and the children were relatively young. Often an allegation was made to the police and social work organizations before the civil proceeding and investigation by the CPS. The proceedings generally concerned matters relating to the custody of and access to the children. It was very rarely possible to determine whether the child sexual abuse had actually taken place. Only three fathers were convicted of the abuses concerned. One father was acquitted and two fathers were wrongfully identified as suspects. Civil judges who have to make decisions about the children are faced with a double dilemma: firstly, the decision of whether or not to take the allegation seriously can have damaging consequences for the children involved. Secondly, the choice to proceed with further investigation and aid within the family, due to uncertainty as to the veracity of the allegation(s) in question, can lead to a prolonged process that damages the child. The study shows that the CPS often advises the court to postpone definitive decisions about the children so that social work organizations can provide more information on the matter at hand. However, the study also shows that it is generally not the potential abuse, but the allegation itself that the CPS expresses concern about.

    Nederlandse kinderen lijken minder te weten over kinder- en mensenrechten dan andere kinderen in Europa. Om die reden zien beleidsmakers, wetenschappers en maatschappelijke organisaties een noodzaak om formele educatie op deze onderwerpen te introduceren in alle onderwijsniveaus. Wat denken middelbare leerlingen zelf hier echter over? Dit artikel onderzoekt het rechtsbewustzijn van kinderen in drie Nederlandse middelbare scholen ten aanzien van hun specifieke rechten als kinderen. Het wordt duidelijk dat kinderen ideeën en meningen hebben over hun rechten en daarmee een rechtsbewustzijn hebben, ook als zij geen rechtenjargon gebruiken. Hun rechtsbewustzijn bestaat uit moraliteit, wat verklaart dat zij bepaalde rechten zelf bedenken: sommige thema’s vinden zij zo belangrijk dat zij voelen dat ze deel uitmaken van hun fundamentele rechten als kinderen. Het integreren van mensenrechteneducatie in het schoolcurriculum zou een nodige, maar is een onvoldoende oplossing voor het ‘probleem’ dat voor ons ligt. Het is namelijk niet bewezen of meer kennis op deze onderwerpen ook leidt tot verandering van gedrag. De kinderen maakten namelijk ook bewuste keuzes om níet hun rechten in te roepen, maar om hun problemen anderszins op te lossen. Dit moet worden meegenomen om interventies effectief te laten zijn, zodat niet het tegenovergestelde van wat gewenst is, wordt bereikt. En effectieve interventies dienen daarnaast aan te sluiten bij het dagelijks leven van de kinderen. Volgens de leerlingen zijn kinderrechten vooral ook iets dat we moeten doen en oefenen.
    Dutch children seem to be less informed about children’s and human rights than their peers in other European states. Therefore, policy makers, academics and CSOs recognise a need to introduce formal education on these matters in all levels of schooling. But what do secondary school children themselves think about this? This article explores the legal consciousness of children in three Dutch schools on their specific rights as children. It has been evidenced that children have ideas and opinions about their rights and therefore have a legal consciousness, though without using the language of the law. Their legal consciousness consists of morality, which explains their ‘invention’ of certain rights: some themes are of such importance that they feel these are part of their fundamental rights as children. Integrating human rights education into the school curriculum may be a necessary, but is an insufficient solution to the ‘problem’ at hand. It has not been evidenced whether more knowledge changes their behavior. The children made informed decisions to not invoke their rights, and to solve their problems differently. Effective interventions need to take this into account in order to relate to their everyday lives and avoid having the opposite effect of what is intended. According to the students, children’s rights are mostly something to be done or practiced.

    This paper provides first of all the introduction to this special issue on ‘Legal constraints on the indeterminate control of “dangerous” sex offenders in the community: A European comparative and human rights perspective’. The issue is the outcome of a study that aims at finding the way legal control can not only be an instrument but also be a controller of social control. It is explained what social control is and how the concept of moral panic plays a part in the fact that sex offenders seem to be the folk devils of our time and subsequently pre-eminently the target group of social control at its strongest. Further elaboration of the methodology reveals why focussing on post-sentence (indeterminate) supervision is relevant, as there are hardly any legal constraints in place in comparison with measures of preventive detention. Therefore, a comparative approach within Europe is taken on the basis of country reports from England and Wales, France, Germany, The Netherlands and Spain. In the second part of the paper, the comparative analysis is presented. Similar shifts in attitudes towards sex offenders have led to legislation concerning frameworks of supervision in all countries but in different ways. Legal constraints on these frameworks are searched for in legal (sentencing) theory, the principles of proportionality and least intrusive means, and human rights, mainly as provided in the European Convention on Human Rights to which all the studied countries are subject. Finally, it is discussed what legal constraints on the control of sex offenders in the community are (to be) in place in European jurisdictions, based on the analysis of commonalities and differences found in the comparison.

    This article presents an overview of the legal regime provided in the Spanish system of criminal sanctions regarding the control of dangerous sex offenders in the community. It focuses on the introduction, in 2010, of a post-prison safety measure named supervised release. We describe the context of its introduction in the Spanish Criminal Code, considering the influence of societal upheaval concerning dangerous sex offenders in its development, and also the historical and theoretical features of the Spanish system of criminal sanctions. We also analyse the legal framework of supervised release, the existing case law about it and how the legal doctrine has until now assessed this measure. After this analysis, the main aim of this article consists in evaluating the effectiveness and the proportionality of the measure, according to the principle of minimal constraints and the rehabilitative function of the criminal sanctions in Spanish law, stated in Article 25.2 of the Spanish Constitution.

    France literally ‘discovered’ sexual abuse following neighbour Belgium’s Dutroux case in the late 1990s. Since then, sex offenders have been the focus of politicians, media and law-makers’ attention. Further law reforms have aimed at imposing mandatory supervision and treatment, and in rare cases, preventive detention. The legal framework for mandatory supervision and detention is rather complex, ranging from a mixed sentence (custodial and mandatory supervision and treatment upon release or as a stand-alone sentence) to so-called ‘safety measures’, which supposedly do not aim at punishing an offence, but at protecting society. The difference between the concepts of sentences and safety measures is nevertheless rather blurry. In practice, however, courts have used safety measures quite sparingly and have preferred mandatory supervision as attached to a sentence, notably because it is compatible with cardinal legal principles. Procedural constraints have also contributed to this limited use. Moreover, the type of supervision and treatment that can thus be imposed is virtually identical to that of ordinary probation. It is, however, noteworthy that a higher number of offenders with mental health issues who are deemed ‘dangerous’ are placed in special psychiatric units, something that has not drawn much attention on the part of human rights lawyers.

    Emergency responders are often sent to the front line and are often confronted with aggression and violence in interaction with citizens. According to previous studies, some professionals experience more workplace violence than others. In this article, the theoretical framework to study variations in workplace violence against emergency responders is described. According to criminal opportunity theories, which integrate the routine activity theory and lifestyle/exposure theory, victimisation is largely dependent on the lifestyle and routine activities of persons. Situational characteristics that could be related to workplace violence are organisational or task characteristics, such as having more contact with citizens or working at night. However, they do not provide insight in all aspects of influence, and their usefulness to reduce victimisation is limited. Therefore, it is important to consider the role of personal characteristics of the emergency responders that may be more or less ‘attractive’, which is elaborated upon by the victim precipitation theory. Psychological and behavioural characteristics of emergency responders may be relevant to reduce external workplace violence. The author argues that, despite the risk of being considered as blaming the victim, studying characteristics that might prevent victimisation is needed. Directions for future studies about workplace violence are discussed. These future studies should address a combination of victim and situation characteristics, use a longitudinal design and focus on emergency responders. In addition, differences between professions in relationships between characteristics and workplace violence should be explored.
