    Piketmediation is een vorm van mediation naast rechtspraak maar dan in de vorm van een pressure-cooker. Typerend voor piketmediation is dat de mediation plaatsvindt in het gerechtsgebouw en dat in beginsel direct na het eerste gesprek een terugkoppeling plaatsvindt aan de rechter. Het doel van piketmediation is om een verdere escalatie van het conflict te beperken en partijen een dienst te bieden waardoor zij snel tot een oplossing kunnen komen. Piketmediation wordt veelal aangeboden in de voorlopige voorzieningenprocedure.
    In opdracht van de Raad voor de rechtspraak is empirisch onderzoek uitgevoerd binnen het Amsterdams Centrum voor Familie & Recht (ACFL) van de Vrije Universiteit Amsterdam. In dit onderzoek zijn verschillende aanbiedingsvormen van piketmediation geëvalueerd die worden aangeboden door zeven gerechten: in een aantal gerechten zijn piketmediation pilots uitgevoerd en in andere is piketmediation reeds een reguliere werkwijze is geworden. In totaal zijn er 120 dossiers gescoord, 39 interviews afgenomen en een expertmeeting gehouden met 14 professionals. De bevindingen uit het dossieronderzoek, de interviews en de expertmeeting tezamen hebben geleid tot een algemeen rapport over de best practices en knelpunten van piketmediation met enkele aanbevelingen betreffende vormen van piketmediation die goed blijken te werken in de praktijk.

    Picket mediation (in Dutch: piketmediation) is a form of mediation which runs alongside normal court procedures, and is held in a pressure-cooker-like environment. It typically takes place in the courthouse and in principle, the outcome of the mediation is reported back to the judge after the first session. Such mediation is intended to limit any further escalation of a conflict and also to offer parties a service with which they can quickly resolve a situation themselves. Picket mediation is often offered in the provisional provisions procedure.
    At the request of The Council for the Judiciary, an empirical study of picket mediation was conducted by the Amsterdam Center for Family & Law (ACFL) of the VU University Amsterdam. Various forms of picket mediation as offered by seven courts were evaluated in this study. While some courts are conducting picket mediation pilots, others already have implemented picket mediation as a regular procedure. For this study a total of 120 files were scored, 39 interviews were conducted and an expert meeting was held with 14 professionals. The combined findings from these events have led to a general report on the best practices and challenges of picket mediation. A number of recommendations regarding forms of picket mediation that appear to work well in practice are additionally included.

    This article explores public perceptions of restorative justice through the examination of media articles and negative online reader comments surrounding a high-profile incident in a Canadian university in which a restorative process was successfully engaged. Utilising relational discourse analysis, we identify how restorative justice is presented in the media and how that presentation is taken up by the public. Media representations of restorative justice create understandings among the public that are profoundly different from how many restorative justice advocates perceive it. The aim of this article is to examine media representations of restorative justice and how these are received by the public so that we can respond constructively.

    In May 2019, the World Justice Project (WJP) convened its sixth annual conference to explore the state of access to justice (A2J) in the global context. World Justice Forum VI met in The Hague and published the most recent A2J report compiled after a year of analysis and based on more than a decade of public, government and citizen data. Measuring the Justice Gap revealed less than optimistic data reflecting the lack of significant progress toward fulfilling the United Nations Sustainable Development Goal 16: achieving just, peaceful and inclusive societies by 2030. The 2019 conference showcased many global initiatives seeking to narrow the justice gap. For the most part these initiatives rely on institutional action by governments, financial institutions and NGO’s. As important as these projects are, transforming the access to justice status of the world can also be achieved through actions focused on Justice at the Layer of the Internet. A consensus based governance model can build a legal framework which is not reliant on the enactment of laws, the promulgation of regulations or overcoming the inertia of institutional inaction. This article reviews the learning gleaned from the WJP and the 2019 Forum. It also seeks to augment the great work of the WJP by exploring the potential for justice as delivered by individuals joined in consensus and relying on emerging technologies.

    The central aim of this article is to analyse the manner in which the legal structure of EU citizenship subjectifies Union citizens. I begin by explicating Alexander Somek’s account of individualism as a concept which captures EU citizenship and propose to update his analysis by coining the notion of mobile individualism. By looking at a range of CJEU’s case law on EU citizenship through the lens of the purely internal rule and the transnational character of EU citizenship, I suggest that movement sits at the core of EU citizenship. In order to adequately capture this unique structure of citizenship, we need a concept of individualism which takes movement rather than depoliticisation as its central object of analysis. I propose that the notion of mobile individualism can best capture the subjectivity of a model EU citizen, a citizen who is a-political due to being mobile.

    Background: In many European countries caring responsibilities are being reallocated to the older people themselves to keep the welfare state affordable. This policy is often legitimized with reference to the ethical principle of autonomy. Older people are expected to be autonomous, have freedom to make their own decisions, and be self-reliant and self-sufficient as long as possible.
    Aim: The purpose of this article is to explore whether and how older people can remain autonomous in order to continue living their lives in accordance with their own values in the context of declining professional caring facilities and shrinking social networks, and which concepts of autonomy can guide professionals and other involved parties in facilitating the choices of older people.
    Method: An empirical-ethical approach is used to interpret the moral values enacted in the caring practice for older people. Two cases are presented. One is the narrative of a woman who lives by herself; she has been hospitalized after a fall and hip fracture, but does not want to be operatied. The second is the narrative of man living in a residential home; he wants to be actively involved, doing good deeds like he always did as a Scout. The cases are evaluated with the help of two concepts of autonomy: autonomy as self-determination and relational autonomy.
    Results: In both cases the enactment of autonomy remains problematic. In the case of the woman there was not enough care at home to live up to her own values. After she was admitted to a hospital her wish not to be operated was questioned but ultimately honoured due to compassionate interference by close relatives and her oncologist. In the second case there was not enough space for the man to lead his life in the way he always had; his plans for improving the social environment in the care home were torpedoed by management and ultimately the man decided to step back.
    Conclusion: In order to do justice to the complexity of each empirical case that involves autonomy of an older person more than one concept of autonomy needs to be applied. Relying on self-determination or relational autonomy exclusively will give professionals and all involved parties a restricted view on the situation, where the wishes of older people are at stake. In both cases autonomy was overruled by system procedures and stereotypical ideas about old people as being weak and not able to make their own decisions. Both cases show, however, that older people - even if they are physically and mentally frail - long to remain morally responsible for the direction their lives are taking, in accordance with their own values. They communicate their wish to determine their own future and at the same time they are interdependent on others to realize their (relational) autonomy and require support in their attempt to maintain their identity. This conclusion has implications for the normative behaviour of the professionals who are involved in care and treatment of older people.

    Achtergrond: In veel landen wordt de verantwoordelijkheid voor de zorg voor ouderen naar de ouderen zelf verplaatst, dit teneinde de welvaartstaat betaalbaar te houden. Dit beleid wordt veelal gelegitimeerd met referentie naar het ethische principe van autonomie. Oudere mensen worden geacht autonoom te zijn, vrij te zijn om hun eigen beslissingen te nemen, en om zo lang mogelijk zelfredzaam te blijven.
    Doel: Het doel van dit artikel is om te onderzoeken of en hoe oudere mensen autonoom kunnen blijven teneinde hun leven in overeenstemming met hun eigen waarden te kunnen voortzetten in de context van teruglopende professionele zorgactiviteiten en krimpende sociale netwerken, en welke concepten van autonomie zorgprofessionals en andere betrokken partijen kunnen helpen bij het faciliteren van de keuzes door ouderen.
    Methode: Een empirisch-ethische benadering wordt gebuikt om de morele waarden in de zorgpraktijk voor ouderen te interpreteren. Twee casussen worden gepresenteerd. De eerste is het verhaal van een vrouw die op zichzelf woont. Ze is na een val waarbij haar heup is gebroken, in een ziekenhuis opgenomen, maar ze wil niet geopereerd worden. De tweede is het verhaal van een man die in een verzorgingshuis woont. Hij wil actief betrokken worden en goede dingen doen zoals hij die altijd heeft gedaan toen hij padvinder was. Beide verhalen worden met behulp van twee concepten van autonomie geëvalueerd: autonomie als zelfbeschikking en relationele autonomie.
    Resultaat: In beide casussen blijft de verwezenlijking van autonomie problematisch. In het geval van de vrouw was er thuis onvoldoende zorg om volgens haar waarden te kunnen leven. Toen zij in het ziekenhuis was opgenomen werd haar wens om niet te worden geopereerd tegen gehouden, maar uiteindelijk ingewilligd als gevolg van bemoeienis uit hoofde van barmhartigheid door directe verwanten en haar oncoloog. In het tweede geval was er voor de man onvoldoende ruimte om zijn leven te leiden op de manier zoals hij dat altijd had gedaan. Zijn plannen om de sociale omgeving in het verzorgingshuis te verbeteren werden door het management getorpedeerd en uiteindelijk heeft hij zich ervan teruggetrokken.
    Conclusie: Teneinde recht te doen aan de complexiteit van beide casussen die betrekking hebben op de autonomie van een oudere, dient meer dan één concept voor autonomie te worden ingezet. Het vertrouwen in zelfbeschikking of relationele autonomie alleen zal aan de professionals en alle andere betrokken partijen een beperkt zicht geven van de situatie wanneer het de wensen van ouderen betreft. In beide gevallen werd de autonomie ter zijde geschoven door protocollen en stereotypische ideeën over ouderen als kwetsbare personen die niet in staat zouden zijn om zelf hun beslissingen te nemen. Echter tonen beide voorbeelden aan dat ouderen, zelfs als ze fysiek en mentaal kwetsbaar zijn, de wens hebben om moreel verantwoordelijk te blijven voor de richting die hun leven zal nemen, in overeenstemming met hun eigen waarden. Zij geven de wens aan om hun eigen toekomst te bepalen en tegelijkertijd zijn ze onderling afhankelijk van anderen om hun (relationele) autonomie te verwezenlijken, én hebben ze behoefte aan steun bij hun poging om hun identiteit te behouden. Deze conclusie heeft gevolgen voor het normatieve handelen van professionals die bij de zorg en behandeling van ouderen betrokken zijn.

    Restorative justice can be implemented at different stages of criminal proceedings. In Israel, restorative justice processes are mainly used prior to sentencing, while there are no restorative programmes for adults following sentencing and while serving their prison sentences. The aim of the present study is to examine the possibility of implementing restorative processes within prison walls. To this end, the present study empirically investigates the level of readiness and willingness of prisoners (n = 110) from two large prisons in Israel to participate in restorative processes and examines the psychological mechanisms underlying their attitudes towards actual participation in these processes. The study proposes a model according to which the relationship between the cognitive component of attitude towards victims and the harm caused by the offence (beliefs and thoughts) and the behavioural component of attitude (the inclination to participate in restorative processes) is mediated by the affective component of attitude towards the offence (sense of guilt and shame). The findings of the study support the proposed model. The study also found that the more prisoners perceived the harm they caused as having more dimensions (physical, economic, emotional), the more positive their attitudes towards restorative justice would be. This study will advance research into restorative justice at a stage that has not previously been researched in Israel and has rarely been investigated elsewhere.

    In New Zealand, a scheme for the political post-legislative scrutiny of delegated legislation has operated since 1989. The Regulations Review Committee of the House of Representatives systematically considers delegated legislation and may inquire into matters relating to it. By convention the Committee is chaired by a member of an opposition party and is supported by a dedicated secretariat. It may, on grounds that go beyond vires, draw the attention of the House to any provision of any regulation. If one of its members moves to disallow a statutory instrument, and if debate on the member’s motion is not brought on within a specified period, the instrument ceases to have legal effect. The note considers aspects of the Committee’s jurisdiction, and whether the successful operation of the Committee may have led to excess focus on the scrutiny of delegated legislation at the expense of the systemic post-enactment scrutiny of primary legislation.

The Role of National Human Rights Institutions in Post-Legislative Scrutiny

    This article explores the role of national human rights institutions (NHRIs) in post-legislative scrutiny (PLS), a topic that has been notably neglected in existing literature. The present research demonstrates that (1) legislative review is actually part of NHRIs’ mandate and (2) the applicable international standards (e.g. Belgrade and Paris Principles) provide for their actorness in all stages of legislative process. The main hypothesis is that NHRIs have already been conducting activities most relevant for PLS, even though they have not often been labelled as such by parliaments or scholars. In other words, we argue that their de facto role in PLS has already been well established through their practice, despite the lack of de jure recognition by parliamentary procedures. We support this thesis by providing empirical evidence from national practices to show NHRIs’ relevance for PLS of both primary and secondary legislation. The central part of this article concentrates on the potential of NHRIs to act as (1) triggers for PLS, and (2) stakeholders in PLS that has already been initiated. The article concludes with a summary of the results, lessons learned, their theoretical and practical implications and the avenues for further research.

    These days, it appears to be common ground that what is illegal and punishable offline must also be treated as such in online formats. However, the enforcement of laws in the field of hate speech and fake news in social networks faces a number of challenges. Public policy makers increasingly rely on the regu-lation of user generated online content through private entities, i.e. through social networks as intermediaries. With this privat-ization of law enforcement, state actors hand the delicate bal-ancing of (fundamental) rights concerned off to private entities. Different strategies complementing traditional law enforcement mechanisms in Europe will be juxtaposed and analysed with particular regard to their respective incentive structures and consequential dangers for the exercise of fundamental rights. Propositions for a recommendable model honouring both pri-vate and public responsibilities will be presented.

    Face-to-face negotiation is the preferred communication style for negotiation, as it is the richest form of communication (Daft & Lengel, 1986), allowing for words, gestures and body language to be clearly communicated. This form of communication also allows for instant feedback, essential in negotiation when it is imperative to check understanding of each other’s views and priorities. Bodtker and Jameson (2001) argue that experiencing emotion is one way we recognize conflict. Invariably, dispute resolution involves emotion, which if allowed to flood the substantive issues, otherwise known as emotional flooding, may result in disputants incapable of acting rationally (Jones & Bodtker, 2001), which may lead to unfair solutions. For example, in high-stress negotiations of family disputes, it may be difficult to think rationally about both the disputants and children’s future needs. This may lead to people having to live with a less-than-ideal financial situation that is not representative of their future needs. Online dispute resolution (ODR) systems involve the use of technology to aid (or in some instances to replace) human communication in the dispute resolution process. This means replacing a very rich form of communication with a lower form of media, with the lowest being text-based forms of communication. ODR using video-conferencing technology benefits disputants located in different areas, hence providing a good medium for those who geographically cannot meet in person. While also a fairly rich mode of communication, this type of technology is heavily dependent on infrastructure variables, such as Internet speed, application support and connectivity issues, which are not always available. In this article, we will introduce the concept of how ODR can support face-to-face negotiations by re-introducing our software AssetDivider as a method to support the face-to-face process in negotiation.

    This article examines the burgeoning trend of creating court ODR systems, focusing on the design aspects that are likely to raise ethical challenges. It discusses four salient questions to be considered when designing a court ODR system, and the resulting ethical tensions that are brought to the fore. As a fourth party, the ODR system not only replaces existing court functions, but enlarges the scope of the courts’ intervention in disputes and increases the courts’ interface with the user. Furthermore, certain ethical principles such as transparency, accountability, impartiality and fairness take on greater significance in the court context than in private ODR, because of the association of the courts with substantive and procedural justice. As in any dispute resolution system, a coherent and effective court ODR system should be guided by dispute system design principles, which includes having clarity of the system’s underlying values and purposes. It is therefore pertinent for each court to resolve the key ethical tensions in order to articulate the foundational values that will undergird the design of its ODR system.

    Feminists have viewed the implementation of restorative practices warily, particularly in the context of gender-based harms. Concerns include the devaluing of gender-based harms, the reprivatisation of violence against women and the inability of restorative practitioners to guarantee safety for people subjected to abuse. But this article will argue that restorative justice can be a uniquely feminist practice, growing out of the same mistrust of state-based systems and engagement of the community that animated the early feminist movement. Although some caution is warranted, restorative justice serves the feminist goals of amplifying women’s voices, fostering women’s autonomy and empowerment, engaging community, avoiding gender essentialism and employing an intersectional analysis, transforming patriarchal structures and ending violence against women.

    The human services are fraught with history of failure related to grasping oversimplified, across-the-board solutions that are expected to work in all situations for all groups of people. This article reviews some of the long-standing and current challenges for governance of programmes in maintaining cultures that safeguard restorative and responsive standards, principles and values, thereby amplifying and enhancing their centrality to relational engagement within families, groups, communities and organisations. Despite their potential for helping groups of people grapple with the complex dynamics that impact their lives, restorative justice approaches are seen as no less vulnerable to being whittled down to technical routines through practitioner and sponsor colonisation than other practices. This article explores some of the ways culture can work to erode and support the achievement of restorative standards, and why restorative justice and regulation that is responsive to the ongoing experiences of affected persons offers unique paths forward for achieving justice. Included in this exploration are the ways that moral panic and top-down, command-and-control management narrow relational approaches to tackling complex problems and protect interests that reproduce social and economic inequality.

    Drawing upon Gert Biesta’s concept of the learnification of education, we maintain that a meaningful purpose for Canadian schools has been lost. We demonstrate that the very fact of relationship is limited in curricula. The absence of relationality enables the continued privilege of normative identities. A restorative approach, based on asking who is being educated, could repurpose schooling. We draw upon examples from literature, current political events and our classroom-based research to illustrate how conflict dialogue, based on relational pedagogy, offers one path for a restorative approach. We conclude that conflict dialogue provides opportunities to engage diverse students in inclusive curricular experiences. Such a restorative approach exposes and explores the who of education for the purpose of promoting positive social conditions that allow for human flourishing.
