De Vereeniging voor Wijsbegeerte des Rechts (VWR) is opgericht op 28 december 1918. Zij had tot doel de studie van de rechtsfilosofie en het maatschappelijk leven. Deze studie moest tevens relevant zijn voor de rechtspraktijk. Vanaf haar oprichting kende de VWR een sterke internationale oriëntatie, aanvankelijk gericht op Duitsland, later vooral op het Verenigd Koninkrijk en de VS. In de jaren zeventig en tachtig van de vorige eeuw beleefde de VWR wat betreft belangstelling en ledenaantal haar hoogtepunt. In 2016 besloot zij – na een gestage neergang – de band met de Nederlandstalige (praktijk)jurist weer aan te halen. |

Nederlandse kinderen lijken minder te weten over kinder- en mensenrechten dan andere kinderen in Europa. Om die reden zien beleidsmakers, wetenschappers en maatschappelijke organisaties een noodzaak om formele educatie op deze onderwerpen te introduceren in alle onderwijsniveaus. Wat denken middelbare leerlingen zelf hier echter over? Dit artikel onderzoekt het rechtsbewustzijn van kinderen in drie Nederlandse middelbare scholen ten aanzien van hun specifieke rechten als kinderen. Het wordt duidelijk dat kinderen ideeën en meningen hebben over hun rechten en daarmee een rechtsbewustzijn hebben, ook als zij geen rechtenjargon gebruiken. Hun rechtsbewustzijn bestaat uit moraliteit, wat verklaart dat zij bepaalde rechten zelf bedenken: sommige thema’s vinden zij zo belangrijk dat zij voelen dat ze deel uitmaken van hun fundamentele rechten als kinderen. Het integreren van mensenrechteneducatie in het schoolcurriculum zou een nodige, maar is een onvoldoende oplossing voor het ‘probleem’ dat voor ons ligt. Het is namelijk niet bewezen of meer kennis op deze onderwerpen ook leidt tot verandering van gedrag. De kinderen maakten namelijk ook bewuste keuzes om níet hun rechten in te roepen, maar om hun problemen anderszins op te lossen. Dit moet worden meegenomen om interventies effectief te laten zijn, zodat niet het tegenovergestelde van wat gewenst is, wordt bereikt. En effectieve interventies dienen daarnaast aan te sluiten bij het dagelijks leven van de kinderen. Volgens de leerlingen zijn kinderrechten vooral ook iets dat we moeten doen en oefenen. |

The European Commission publishes bi-annual internal market scoreboards which show the member states’ performance in realizing internal market rules. Timely and correct transposition of internal market directives is a crucial part hereof. Member states are regarded as unitary actors. Consequently the Commission does not differentiate the performances of their constituent sub-national entities. This article constructs the internal market scoreboards for Flanders (2009-2013) and holds these against the Belgian performance. In order to frame the fluctuations in the Flemish performance per scoreboard, external and internal factors that help explain maltransposition are pretested in the Flemish case. Flanders struggles with transposition, transposing barely a fourth of the directives under its competence timely and correctly, with timeliness being most problematic. The factors that seem to be connected to this performance, however, are structural and cannot easily be influenced. Further research is needed to go from this exploration toward explaining maltransposition in Flanders. |

Little is known about views on democracy of adolescents. In this article we describe results of our interview study with forty adolescents of fourteen years old on their views of democracy and decision making. The study focuses on the daily lives of adolescents and decision making within local contexts, such as the classroom. The adolescents’ views on decision making appear to correspond to the models of democracy as we know them, that is majoritarian democracy (the largest group), consensual democracy or deliberative democracy. However, only some of the adolescents have an explicit understanding of the concept of democracy and most have limited political knowledge. For these students, the experience or feeling of being part of a political democracy is still something ‘far away’ and not something of any relevance in their daily lives. |

This article examines what limitations to private property John Locke recognizes to protect the rights of the poor. As has been pointed out in the literature, Locke’s ideas on the limitations to private property have been influenced by medieval discussions about the rights of the poor and the principle of extreme necessity. Confirming this interpretation, the article shows that Locke borrows the distinction between ‘ordinary need’ and ‘evident and urgent necessity’ from Thomas Aquinas. Taking position in a debate among Grotius and Pufendorf, Locke argues that the poor have a natural right to the ‘surplus’ of somebody else’s possessions, and that this right becomes legally enforceable in case of ‘evident and urgent necessity.’ |

In this article I reconstruct the contribution of some central Hellenistic political thinkers to a theory of human rights. Starting point is the traditional Stoic conception of the law of nature as a power in which only perfect human beings actively participate. In the 2nd century BC the Stoic Panaetius adjusted this traditional high-minded theory by also allowing for a lower level of human excellence. This second-rate human excellence can be achieved just by following ‘proper functions’, which are derived from ordinary human nature and can be laid down in rules. From here, it was only a small, yet decisive step – presumably to be attributed to one of Cicero’s teachers – to discard the highest level of human perfection altogether. This step, I argue, paved the way for an understanding of the rules of natural law in terms of human rights. |

The legal scholars Paul Scholten (1875-1946) and Herman Dooyeweerd (1894-1977) had much in common. The most significant agreement is their emphasis on the influence of a (religious) worldview on legal scholarship and practice. Unfortunately, they never met to discuss the similarities and differences of their jurisprudential ideas. In this article I try to reconstruct this conversation which never took place. Scholten’s legal thought is specifically oriented to the practice and difficulties of judging. Dooyeweerd above all was a philosopher whose specific philosophy of the modal aspects of reality is the basis for his thinking about the law. Both scholars emphasized the importance of legal principles. They also identified several fundamental legal categories and concepts. However, their methodology is different. The way religion and morality influence their legal thought is also different. A discussion of the contemporary relevance of their work completes the paper. |

On December 1st 2005, Belgian Prime Minister Guy Verhofstadt proposed the creation of a ‘United States of Europe’: a core group of Eurozone countries surrounded by a confederation of states. A European social-economic policy, technology cooperation, a common justice and security policy, a common diplomacy and army will make the EU stronger and less patronizing, said Verhofstadt. In this article, we look back over the main political and economic developments in the EU in 2005. This year will probably go down in EU history as the year in which the constitutional treaty was rejected. Yet, as demonstrated, despite a feeling of total malaise, a number of knotty dossiers came to a conclusion and new initiatives were taken. |
