    Deze analyse bespreekt uitvoerig de argumenten van voor- en tegenstanders van het wetsvoorstel ter versoepeling van de Belgische abortuswetgeving (2019-…). Het fel bediscussieerde wetsvoorstel beoogt het zelfbeschikkingsrecht van de zwangere persoon uit te breiden en abortus te destigmatiseren. Door vrijwillige zwangerschapsafbreking als gezondheidszorg te kwalificeren geven de indieners van het wetsvoorstel tevens de voorkeur aan een gezondheidsrechtelijk traject op maat van de zwangere persoon als patiënt. De inkorting van de wachtperiode-en het schrappen van abortusspecifieke informatieverplichtingen geven in die zin blijk van vertrouwen in de zwangere persoon, in het kwalitatief handelen van de zorgverlener en in de waarborgen die het gezondheidsrecht reeds biedt. De wetgever dient met andere woorden uit te maken (1) welke regels hij in de context van abortus nodig acht, (2) of deze regels reeds worden gewaarborgd door de algemene gezondheidswetten- en deontologie, en (3) of de vooropgestelde regels hun doel bereiken. Een uitbreiding van het zelfbeschikkingsrecht van de zwangere persoon wordt tevens bewerkstelligd door de termijnuitbreiding van twaalf naar achttien weken voor abortus op verzoek. Een keuze voor een termijn is steeds in zekere mate willekeurig, doch reflecteert een beleidsethische keuze waarbij wordt gezocht naar een evenwicht tussen de bescherming van ongeboren leven en het zelfbeschikkingsrecht van de zwangere persoon. Praktische bekommernissen vormen hierbij geen fundamenteel bezwaar tegen een termijnuitbreiding maar dienen, in overleg met de betrokken sector, te worden geanticipeerd en maximaal te worden opgevangen door middel van organisatorische (niet-noodzakelijk juridische) initiatieven. Ten slotte beogen de indieners van het wetsvoorstel opheffing van alle strafsancties voor vrijwillige zwangerschapsafbreking. Op rechtstheoretisch vlak blijven echter vragen bestaan omtrent de manier waarop dit voorstel een volledige depenalisering doorvoert. Hoewel het tuchtrecht enige rol kan spelen bij gebrek aan strafsancties, creëert de vooropgestelde depenalisering van ongeoorloofde zwangerschapsafbreking door een arts een rechtsonzekere situatie.

    This analysis extensively discusses the arguments of supporters and opponents of the legislative proposal to relax the Belgian abortion legislation (2019-…). The heavily debated proposal primarily aims to expand the pregnant person’s right to self-determination and to destigmatise abortion. By qualifying consensual termination of pregnancy as health care, the supporters of the proposal also prioritise an individualised, health-oriented approach towards the pregnant person as patient. In the same vein, the diminished waiting period and the removal of abortion-specific information duties express trust in the pregnant person, in the qualitative conduct of the health care provider, and in the guarantees that the health law already provides. In other words, the legislator must determine 1) which regulations it deems necessary in the context of abortion, 2) whether these regulations are already guaranteed by general health laws and ethics, and 3) whether the proposed regulations achieve their intended purpose. An expansion of the pregnant person’s right to self-determination is also achieved by the extension from twelve to eighteen weeks as a limit for abortion on request. Although a time limit is always arbitrary to some extent, it mainly reflects a policy-ethical decision in which a balance is sought between the protection of unborn life and the pregnant person’s right to self-determination. Practical concerns do not establish a fundamental objection to the extension of such limit, but must, in consultation with the medical profession, be anticipated and dealt with as much as possible by means of organisational (not necessarily legal) initiatives. Finally, the proposal lifts all criminal sanctions currently applicable to consensual termination of pregnancy. On a legal-theoretical level, however, questions remain about the way in which the proposal implements full depenalisation. Although disciplinary law can play some role in the absence of criminal sanctions, the depenalisation of unlawful termination of pregnancy by a health care professional produces legal uncertainty.

    Gijsbert Karel van Hogendorp is the auctor intellectualis of the 1818 Dutch constitution. It was his sketch for a new constitution that was used as a starting point for the deliberations of its original drafting committee. Van Hogendorp justifies his constitution as a restoration of the Burgundian constitution that applied before the Dutch Republic. In recent literature Van Hogendorp’s restorational argument is presented as an invention of tradition. In this article an alternative explanation is presented, namely that it is part of a form of classicist political thought that was common during the ancien régime. Van Hogendorp describes his constitution as a moderate monarchy, in which the three principles of monarchy, aristocracy and democracy are properly balanced. And he mainly defends this mixed regime by pointing out that it is a restoration of the old Burgundian constitution of the Netherlands. This way of reasoning is, as will be shown, typically classicistic.

    In the light of the broader debate on the mediatization of politics, this study wants to better understand how the media perceptions and media behaviour of politicians are related to their appearances in the news. We opt for an innovative actor-centred approach to actually measure the views and actions of individual politicians. We combine surveys conducted with 142 Belgian representatives with data on politicians’ external communication behaviour and on their appearances in television news, newspapers and news websites. The results show that media behaviour is not so much related to beliefs of media importance. We do find a significant positive relationship between strategic media behaviour and media attention suggesting that politicians who put in more effort appear more often in various news media. However, this positive relationship depends on the specific form of strategic communication and the political position of the legislator. Our study adds to the mediatization literature by showing how and when politicians are successful in obtaining media attention.

    This paper considers access to the rule of law as a requirement for the well-functioning of the rule of law in society. In most rule of law debates, access to the rule of law is not a topic of discussion because these scholars focus themselves solely on the legalistic dimension of the rule of law. Barber was the first to mention the social dimension explicitly but without a theoretical framework. Based on the three capitals of Bourdieu, this paper offers a framework to determine the elements of the social dimension. With these capitals, barriers to the access to the rule of law for individuals can be identified, and solutions can be offered.

    The role that Paul Scholten assigns to conscience in his legal methodology still leads to heated discussions in literature after almost 100 years. Recognizing that in case law the conscience of the judge can be of decisive importance is apparently problematic. It would facilitate political court rulings, make judicial judgment uncontrollable and could be arbitrary for the parties to the legal dispute. Not only Scholten’s view on the role of conscience in judicial decision making is “a stumbling block”. At least as great is the fuss about his representation of conscience. Only Christian lawyers could identify with this. This article attempts to shed new light on the above points of criticism by drawing attention to the following aspects of Scholten’s legal methodology: the role of the facts in establishing the law, the nature of the legal judgment and finally the grounds on which conscience may be determined.

How Issue Salience Pushes Voters to the Left or to the Right

    Recent research demonstrates that political parties in western Europe are generally structured along one dimension – and often take more or less similar ideological positions on the economic and cultural dimension – whereas the policy preferences of voters are structured two dimensionally; a considerable part of the electorate combines left-wing stances on one dimension with right-wing stances on the other. These ideologically ‘unserved’ voters are the main focus of this study. Using data from a large-scale survey in Flanders and Wallonia, we demonstrate how the salience of the two dimensions explains whether these unserved voters ultimately end up voting for a right-wing or a left-wing party. Specifically, we show that these voters elect a party that is ideologically closest on the dimension that they deem most important at that time. To summarise, the findings of this study confirm that salience is a key driver of electoral choice, especially for cross-pressured voters.

    Recently, studies have burgeoned on the link between populism and demands for democratic reforms. In particular, scholars have been debating the link between populist citizens or voters and support for referendums. In this article, we examine voters of populist parties (Vlaams Belang (VB) and Parti du Travail de Belgique-Partij van de Arbeid (PTB-PVDA)) in Belgium in 2019 and we look at their attitudes towards various types of democratic reforms. We find that voters of populist parties differ from the non-populist electorate in their support for different kinds of reforms of representative democracy. Voters of VB and PTB-PVDA have in common stronger demands for limiting politicians’ prerogatives, for introducing binding referendums and for participatory budgeting. While Vlaams Belang voters are not significantly different from the non-populist electorate on advisory referendums, citizens’ forums or technocratic reform, PVDA-PTB voters seem more enthusiastic.

    This article contains a critical review of the provisions in the Dutch penal code regarding group defamation and hate speech. It is argued that not only these provisions themselves but also their application by the Dutch supreme court, constitutes a problem for the legitimacy and functioning of representative democracy. This is due to the tendency of the supreme court to employ special constraints for offensive, hateful or discriminatory speech by politicians. Because such a special constraint is not provided or even implied by the legislator, the jurisprudence of the supreme court is likely to end up in judicial overreach and therefore constitutes a potential – if not actual – breach in the separation of powers. In order to forestall these consequences, the protection of particularly political speech should be improved, primarily by a revision of the articles 137c and 137d of the Dutch penal code or the extension of parliamentary immunity.

    Een rechtsstaat is gebaseerd op zelfbinding van de overheid aan het recht. Deze zelfbinding moet verankerd zijn in regels die onder meer de onafhankelijkheid van de rechterlijke macht vastleggen. De ontwikkelingen in Polen en elders tonen echter aan dat juridische regels van zelfbinding geen blokkades maar verkeersdrempels zijn op de weg naar despotisch bestuur. Een rechtsstaat vereist vooral een cultuur van zelfbinding. De conceptualisering van deze rechtsstaatcultuur staat nog in de kinderschoenen.

    In this article we elaborate on the place of religion in the workplace. Does the individual freedom of religion imply that employers must always accommodate the religious claims of employees or can they boast a number of arguments allowing them to legitimately limit that freedom? And, conversely, do employers not also have a right to freedom of religion and a right to formulate certain religious expectations for their employees? In this contribution, we deal with these and related questions from a legal-philosophical perspective. The overall aim is to illustrate the extent to which univocal answers are jeopardized because of conceptual ambiguities. We first make a normative distinction between two strategies (i.e. difference-blind approach and difference-sensitive approach) and subsequently illustrate and elaborate on how and why these strategies can lead to different outcomes in legal cases. We illustrate the extent to which a contextual and proportional analysis can be a way out in theoretical and practical conundrums.

    In countries like Belgium and The Netherlands, there seems to be overwhelming public acceptance of transplantation and organ donation. Yet, paradoxically, part of the public refuses post-mortal donation of their own organs or of those of family members. It is customary within the transplantation context to accept the refusal of organ donation by family members “in order to accommodate their feelings”. I argue that this attitude does not take seriously what is really behind the refusal of donation by (at least some) family members. My hypothesis is that even in very secularized societies, this refusal is determined by cultural-symbolic attitudes vis-à-vis the (dead) human body (and some of its parts). The blind spot for this reality, both in the practice of and discussions around organ donation, prevents understanding of what is producing the paradox mentioned.

    Ever since it was published in 2015, the judgment of the The Hague court in the so-called Urgenda-case, and the subsequent decisions of the appellate and cassation courts confirming it, have been met with repeated and vivid critiques. By recognizing the necessity of the reduction in greenhouse gas emissions, and furthermore imposing a certain reduction level on the Dutch state, the judgments in the cases at hand gave rise to many questions concerning the position of the judiciary in the matter, and in Dutch society as a whole. This article attempts in the first place to situate the positions of the different actors intervening in the Urgenda-case within a legal-theoretical framework. The contribution subsequently explores the strategic possibilities that an alternative understanding of law could offer to the judges, focusing specifically on the use of legal instruments stemming from international law, brought into the reasoning of the national judge.

    Despite the enduring importance of Lijphart’s work for understanding democracy in Belgium, the consociational model has come under increasing threat. Owing to deep political crises, decreasing levels of trust in elites, increasing levels of ethnic outbidding and rising demands for democratic reform, it seems as if Lijphart’s model is under siege. Even though the consociational solution proved to be very capable of transforming conflict into cooperation in Belgian politics in the past, the question we raise in this article is whether and to what extent the ‘politics of accommodation’ is still applicable to Belgian democracy. Based on an in-depth analysis of the four institutional (grand coalition, proportionality, mutual veto rights and segmental autonomy) and one cultural (public passivity) criteria, we argue that consociational democracy’s very nature and institutional set-up has largely hollowed out its potential for future conflict management.

    De grote toestroom van migranten en asielzoekers in de EU houdt vandaag nog steeds verschillende regelgevers wakker. Niet alleen de nationale overheden, maar ook de EU-regelgevers zoeken naarstig naar oplossingen voor de problematiek. Daartoe trachten de EU-regelgevers het Gemeenschappelijk Europees Asielstelsel (GEAS) bij te werken.
    Binnen de groep migranten en asielzoekers bestaat een specifiek kwetsbaar individu: de niet-begeleide minderjarige vreemdeling (NBMV). Hij is zowel vreemdeling als kind en kreeg reeds ruime aandacht binnen de rechtsleer. Nochtans werd deze aandacht niet altijd weerspiegeld in de EU-wetgeving. Het lijkt alsof hij door de regelgevers af en toe uit het oog verloren werd.
    Uit het onderzoek blijkt dat de EU-regelgevers nog een zekere weg te gaan hebben. In de eerste plaats bestaat er wat betreft het geheel aan regels met betrekking tot de NBMV weinig coherentie. De EU-regelgevers zouden bijvoorbeeld meer duidelijkheid kunnen scheppen door een uniforme methode vast te leggen voor de bepaling van de leeftijd van de NBMV. Hetzelfde geldt voor een verduidelijking van de notie ‘het belang van het kind’ binnen asiel en migratie. Verder blijken de Dublinoverdrachten en de vrijheidsontneming van de NBMV nog steeds gevoelige pijnpunten. Hier en daar moet aan de hervorming van het asielstelsel nog wat gesleuteld worden, zodat de rechten van de NBMV optimaal beschermd kunnen worden.

    Today, the large influx of migrants and asylum seekers into the European Union (EU) keeps several regulators awake. Not only national authorities, but EU regulators too are diligently searching for solutions to the problems. To this end, EU regulators are seeking to update the Common European Asylum System (CEAS).
    There is however a particularly vulnerable individual within the group of migrants and asylum seekers: the unaccompanied alien minor (UAM). These minors already received a great deal of attention within legal doctrine. However, this attention was not always reflected in EU legislation. It seems as if UAM are occasionally lost from sight by the regulators.
    This article shows that the EU regulators still have a certain way to go. First, there is little coherence in the set of rules relating to the UAM. The EU regulators could, for example, create more clarity by laying down a uniform method for determining the age of the UAM. The same applies to a clarification of the notion of 'best interests of the child' within the context of asylum and migration. Second, the proposal for a new Dublin Regulation and the proposal for a new Reception Conditions Directive still appear to be sensitive. Here and there, the reform of the asylum system still needs adjustments, so that the rights of UAM can be optimally protected."

    Sub-constituency campaigning occurs when parties focus their campaign resources on specific geographical areas within an electoral district. This behaviour was traditionally thought to occur only in single-member plurality elections, but recent research demonstrates that proportional systems with multi-member districts can also elicit sub-constituency campaigning. However, most studies of sub-constituency campaigning rely on self-reported measures of campaigning, not direct measures of campaign intensity in different regions and communities. We present novel data on geographical variations in the intensity of Flemish parties’ campaign advertising during the 2014 general elections in Belgium, which provides a direct measure of sub-constituency campaigning. Our findings show clear evidence of sub-constituency campaigning: parties campaign more intensely in municipalities where they have stronger electoral support and in municipalities with greater population density.
