This article is part of a broader discussion about attaining a full-fledged child-friendly (criminal) justice. Attaining that goal is particularly challenging in cases of international parental abduction, due to the involvement of two branches of law. It is examined to what extent the current interaction guarantees a decision in the best interests of the child. More specifically, the implications of the adage le criminel tient le civil en état are scrutinised from a children’s rights perspective. |

Alternative/amicable dispute resolution (ADR) is omnipresent these days. In line with global evolutions, the Belgian legislator embraced the use of these ADR mechanisms. Recent reforms of the law, first in 2013 with the act concerning the introduction of a Family and Juvenile Court and consecutively in 2018 with the act containing diverse provisions regarding civil law with a view to the promotion of alternative forms of conflict resolution, implemented more far-reaching measures to promote ADR than ever before. The ultimate goal seems to alter our society’s way of conflict resolution and make the court the ultimum remedium in case all other options failed.In that respect, the legislator took multiple initiatives to stimulate amicable dispute resolution. The reform of 2013 focused solely on family cases, the one in 2018 was broader and designed for all civil cases. The legal tools consist firstly of an information provision regarding ADR for the family judge’s clerk, lawyers and bailiffs. The judges can hear parties about prior initiatives they took to resolve their conflict amicably and assess whether amicable solutions can still be considered, as well as explain these types of solutions and adjourn the case for a short period to investigate the possibilities of amicable conflict resolution. A legal framework has been created for a new method, namely collaborative law and the law also regulates the link between a judicial procedure and the methods of mediation and collaborative law to facilitate the transition between these procedures. Finally, within the Family Courts, specific ‘Chambers of Amicable Settlement’ were created, which framework is investigated more closely in this article. All of these legal tools are further discussed and assessed on their strengths and weaknesses. |

The central question in this article is whether an empirical-legal approach of victimhood and victim rights could offer a sufficient basis for proposals of legal reform of the legal system. In this article, we choose a normative-critical approach and raise some objections to the way in which part of such research is currently taking place in the Netherlands, on the basis of two examples of research in this field, one dealing with compelled apologies as a possible remedy within civil procedural law and the other with the victim’s right to be heard within the criminal legal procedure. In both cases, we argue, the strong focus on the measurable needs of victims can lead to a relatively instrumental view of the legal system. The legal system must then increasingly be tailored to the wishes and needs of victims. Within this legal-empirical, victim-oriented approach, there is little regard for the general normative principles of our present legal system, in which an equal and respectful treatment of each human being as a free and responsible legal subject is a central value. We argue that results of empirical-legal research should not too easily or too quickly be translated into proposals for legal reform, but first become part of a hermeneutical discussion about norms and legal principles, specific to the normative quality of legal science itself. |

Sinds de invoering van het Burgerlijk Wetboek in 1838 heeft men herhaaldelijk getracht de gronden voor echtscheiding te verruimen. Hoewel deze gronden uiteindelijk pas verruimd werden in 1971, werd de tot die tijd bestaande situatie, waarbij echtscheiding slechts op vier gronden mogelijk was en echtscheiding met wederzijds goedvinden verboden was, als onwenselijk beschouwd. Dit gevoelen werd nog sterker na het arrest van de Hoge Raad uit 1883, de zogenaamde 'Groote Leugen'. Teneinde een einde te maken aan deze 'Groote Leugen' en in een poging het Nederlandse echtscheidingsrecht meer in lijn te brengen met het Duitse recht, heeft de Nederlandse secretaris-generaal voor Justitie, J.J. Schrieke, tussen 1942 en 1944 twee wijzigingsvoorstellen voorgelegd aan de Duitse autoriteiten welke destijds Nederland bezet hielden. Dit artikel analyseert beide wijzigingsvoorstellen en probeert een antwoord te geven op de vraag in hoeverre deze voorstellen het resultaat waren van een mogelijke invloed van het Nationaal Socialisme. |

This article explores the themes of injustice and dehumanization in Aeschylus’ Oresteia and Yael Farber’s Molora, in which the story of the Oresteia is dramatized against the backdrop of post-apartheid South Africa. It is argued that both plays depict wrongdoers and victims alike as social outcasts. Thus, they can both be described with Paul Ricoeur as ‘sketches of a man,’ not being able to live up to their full human potential. Borrowing from Ricoeur’s legal philosophy, it is then explained how public trials and hearings help them to reintegrate into society, in which they can regain their full humanity. |

The last local elections in Wallonia were marked by the introduction of a new legislation concerning the way mayors are appointed. Before 2006, mayors were appointed by the regional government. Since the last elections, a new decree institutes that is automatically appointed mayor the candidate having most preferential votes from the list having most seats. In this article, we explore how the new legislation has affected the way voters behave in 2006 and also how it has affected parties when it comes to coalition agreements. What appears is that the new legislation has a fairly limited impact. Voters did not cast more preferential votes in 2006 than in 2000. The logics of coalitions have not been changed significantly. Finally, the only notable – even if not spectacular – impact of the new Walloon decree is that the elections have been much more focused on the candidates that were leading their list, the ones that were presented by their party as their candidate to become mayor. These candidates have more often been appointed mayors in 2006 than in 2000 and the proportion of preferential votes that they have received is higher in 2006. In that sense, even if the degree of change must not be exaggerated, Walloon local elections are slightly turning into a horse race between candidates leading their list. |
